Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Mashy mobile web application, website, and related services (collectively, the "Service") operated by Niblick & Co. LLC ("Niblick & Co.," "we," "us," or "our"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. The Service

Mashy is an AI golf coaching app that analyzes recorded golf swings, offers instructional guidance, tracks rounds and handicap progress, and connects golfers through groups, challenges, and fantasy play. Swing analysis and coaching feedback are generated by automated models and are educational in nature — they are not a substitute for in-person instruction from a qualified PGA or LPGA professional.

3. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you believe your account has been compromised, contact us immediately.

4. Acceptable Use

You agree not to misuse the Service or help anyone else do so. This includes, without limitation: uploading content you do not have the rights to; reverse-engineering, scraping, or attempting to access non-public parts of the Service; interfering with the Service's security or operation; using the Service for any unlawful purpose; or attempting to circumvent billing, credit, or usage limits.

5. Your Content

You retain ownership of the videos, messages, round data, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Niblick & Co. a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to operate the Service for you. You represent that you have all rights necessary to grant this license for any content you upload, including any videos that capture other people.

6. AI Analysis Disclaimer

Swing analysis, drill recommendations, shot-type guidance, and other AI-generated feedback are produced by automated models and may be incomplete, inaccurate, or unsuited to your physical condition or skill level. You are responsible for your own safety and for any decision to act on feedback. Niblick & Co. is not liable for injury, equipment damage, or performance outcomes resulting from following AI guidance.

7. Subscriptions, Credits & Billing

Some features require a paid subscription or credits. Subscription and credit terms, including pricing, renewal, and refund windows, are presented at the point of purchase. Recurring subscriptions renew automatically until canceled. You may manage or cancel a subscription at any time through your account; cancellation stops future renewals but does not refund the current billing period. Credits, where offered, expire per the terms stated at purchase and have no cash value.

8. Third-Party Services

The Service integrates with third-party platforms (for example, video providers, course databases, payment processors, and tour data feeds). Niblick & Co. is not responsible for the availability or accuracy of third-party data or services, and their terms and privacy practices apply to your use of them. Handicap Index® is a trademark of the USGA®, and Mashy is not affiliated with or endorsed by the USGA or PGA Tour.

9. Intellectual Property

The Service's branding, design, software, and original content — including the Mashy name and logo — are owned by Niblick & Co. LLC and protected by applicable intellectual-property laws. Nothing in these Terms grants you any right to use Mashy branding except as displayed within the Service for personal, non-commercial use.

10. Termination

You may delete your account at any time from within the app. We may suspend or terminate access if you violate these Terms, create legal or security risk, or as otherwise described here. Upon termination, your right to use the Service ends, though certain provisions (ownership, disclaimers, limitations of liability) survive.

11. Disclaimers; Limitation of Liability

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Niblick & Co. disclaims all warranties and is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of the Service. Where liability cannot be excluded by law, it is limited to the amount you paid us in the prior twelve (12) months.

12. Governing Law & Disputes

These Terms are governed by the laws of the State in which Niblick & Co. LLC is formed, without regard to conflict-of-laws principles. We will try in good faith to resolve any dispute informally. Any claim not resolved within sixty (60) days shall be brought in the courts of that State, and you and Niblick & Co. consent to exclusive jurisdiction and venue there.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you within the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
